Cayetano at minorya, iginiit ang rules sa gitna ng pagbali ng mayorya sa custody protocol ni Brice Hernandez

Inalmahan ni Senate Minority Leader Alan Peter Cayetano nitong Lunes ang tila “VIP” treatment ng Senado kay ex-Bulacan DPWH Engineer Brice Hernandez, na nakadetine dahil sa umano’y pagsisinungaling sa isang pagdinig ng Senado kaugnay ng flood control projects.

Kasunod ito ng biglaang desisyon ni Senate President Vicente Sotto III na ibalik sa detention facility ng Senado si Hernandez sa kabila ng napagkasunduan sa plenary session noong nakaraang linggo na idetine ito sa Pasay City Jail.

“Y’ung plenary ang pinakamataas at makapangyarihan. Ang question dito, bakit nagbago samantalang may motion at na-approve ito ng buong Senado?” diin ni Cayetano sa isang media interview.

Bago ito, matatandaang habang nasa pagdinig ng House of Representatives noong September 9 ay humiling din si Hernandez na huwag na siyang ibalik sa Senado. Pinayagan ito ni Sotto at idinetine siya sa PNP Camp Crame.

Wika ni Cayetano, hindi tamang hindi nasusunod ang sariling patakaran ng Senado.

“We (minority) are not comfortable na wala tayong rules sa Senado,” aniya.

Si Hernandez ay na-cite in contempt sa isang pagdinig ng Blue Ribbon Committee tungkol sa maanomalyang flood control projects dahil sa pagsisinungaling nito tungkol sa kanyang pagka-casino noong government employee pa siya.

Alinsunod sa Article 6, Section 6, sub-paragraph c ng Rules of the Senate Blue Ribbon Committee, ang Blue Ribbon Committee ang may kapangyarihang magdesisyon kung saan idedetine ang witness nito. Maaari itong magdesisyon nang mag-isa o kasama ang Senate President – pero hindi pwedeng ang Senate President lang.

Giit ni Cayetano, ni hindi kinonsulta ng Senate leadership ang Blue Ribbon Committee bago “baligtarin” ang napagkasunduang mosyon sa plenaryo.

Aniya, ang request pa ni Hernandez ang nasunod sa halip na ang patakaran ng Senado.

“The issue here isn’t where to detain him, but who has the authority and what our rules are,” giit ng minority leader.

“Ang nasusunod dito ay y’ung witness eh. N’ung nand’on siya sa House at sinabi niyang hindi siya komportable sa Senate, hindi siya ibinalik. Ngayon ang statement niya, with the new [Senate] leadership komportable na siya?” dagdag niya.

Sa plenary session kinahapunan, tumindig ang minority bloc ukol sa isyu. Dahil dito, nagpresenta si Majority Leader Juan Miguel Zubiri na gumawa ng “proper motion” sa floor para sama-samang mapagdesisyunan ng mga senador ang ginawang pagbalik kay Hernandez.

Giit naman ni Cayetano, simple lang ang nais ng minorya: ang sundin ng Senado ang sarili nitong rules.

“The problem for us in the minority is… can we rely on the rules?” aniya.
