Santa Rosa, Laguna — The Social Security System (SSS) resumed the conduct of Run After Contribution Evaders (RACE) campaign against non-compliant or delinquent employers last October 20, 2022.  

The RACE campaign facilitated by the Accounts Management Section led by Edwin S. Igharas, Acting Head of Luzon South 1 Division together with Grace Velasco, Branch Head of SSS Santa Rosa Branch, and reminded the employers of their compliance with Republic Act 11199 or the Social Security Act of 2018.  

Under the SS Law, employers are mandated to register their businesses to SSS, report their employees, deduct the amount for the contribution of the employees and remit/pay the monthly contributions. They must also update their employment records such as payrolls and contribution and loan collection lists and present these documents to SSS for inspection.  

The ten establishments visited by the RACE team recorded a total delinquency of an approximate amount of P1.6 million consisting of unpaid contributions of 80 employees including penalties.  

The issued written orders gave the delinquent employers a non-extendible fifteen (15) calendar days to present records that will justify why no charges should be filed against them.  

Timely remittance of the employees’ SS contributions is vital in providing their social security protection. Further, violation of the SSS Law is punishable by a fine of not less than P5,000.00 nor more than P20,000.00, or imprisonment for not less than six (6) years and one (1) day nor more than twelve (12) years or both, at the discretion of the court.  

 “This will serve as a wake-up call for employers to fulfill their obligations under the SSS law. In addition to this, they can also avail the condonation programs of SSS and the Pandemic Relief and Restructuring Program 3 (PRRP 3) Contribution Penalty Condonation, Delinquency Management and Restructuring Program.” Acting Head Igharas said.  

The PRRP 3 offers qualified employers an option to pay their past-due Social Security (SS) and Employee’s Contribution (EC) contributions through installment terms ranging from nine (9) to 60 months, depending on the total amount of delinquency. The program will run until November 21, 2022. 

 

The Contribution Penalty Condonation Program for employers and household employers caters to those who have delinquencies in paying the contributions of their employees and kasambahay. Under this program, penalties on unremitted contributions may be paid through one-time payment or installment term.

Interested employers were advised to coordinate with their assigned Account Officers of their servicing SSS branch who will assist them in their applications.
