Senate Passes Resolution Urging ICC to Grant House Arrest for Duterte

October 1, 2025 – Philippines — The Philippine Senate has adopted Senate Resolution No. 144 formally urging the International Criminal Court (ICC) to consider placing former President Rodrigo Duterte under house arrest due to humanitarian concerns.

The resolution, introduced by Senate Majority Leader Juan Miguel Zubiri and Minority Leader Alan Peter Cayetano, cited Duterte’s advanced age and deteriorating health as grounds for the appeal. It calls on the ICC to designate a physician to assess Duterte’s medical condition and fitness for continued detention.

The measure references Article 10(1) of the International Covenant on Civil and Political Rights, which mandates humane treatment of detained individuals. It also stipulates that any house arrest arrangement should remain subject to ICC-imposed restrictions to safeguard the integrity of ongoing proceedings.

Voting results showed 15 senators in favor, including Zubiri, Cayetano, Imee Marcos, Robin Padilla, Ronald “Bato” dela Rosa, Jinggoy Estrada, Bong Go, Chiz Escudero, Sherwin Gatchalian, Loren Legarda, Erwin Tulfo, JV Ejercito, Panfilo Lacson, Mark Villar, and Rodante Marcoleta. Three senators — Risa Hontiveros, Bam Aquino, and Francis Pangilinan — opposed the resolution, while Senate President Tito Sotto and Raffy Tulfo abstained.

Duterte remains in ICC custody in The Hague, where he faces charges linked to alleged human rights violations during his administration’s war on drugs. While largely symbolic, the resolution highlights a divided stance within the Philippine legislature on balancing humanitarian considerations with international accountability.
