QUEZON — Pormal ng nagsampa ang 19 Barangay Chairman ng bayan ng Mauban sa Ombudsman ng kasong Grave Abuse of Authority ang Municipal Mayor ng Mauban, Quezon, at lahat ng miyembro ng Sangguniang Bayan dahil sa pagsuspende sa mga Barangay chairman sa loob ng anim na buwan nang hindi dumaan sa pormal na pagdinig.

Inaakusahan din ang mga ito na lumabag sa Anti-Graft and Corrupt Practices Act dahil sa pagkuha o pag-hire ng private counsel na binayaran gamit ang pondo ng pamahalaan para lamang gumawa ng complaint for suspension at resolusyon para suspendehin ang mga kapitan ng barangay ng bayan ng Mauban.

Kabilang sa mga kinasuhan sina Mayor Bautista Erwin Dwight Pastrana, Vice Mayor Alween Sardea, Sangguniang Bayan Members Nathaniel Calucin, Abelardo Mandrique, Michael Diasanta, Raquel Almacen, Yolanda Santayana, Juan Lorenzo Pastrana, Edgardo Astoveza, Liza Mandrique, Julieto Espinas, at Marlon Luna.

Kinasuhan sina Mayor Pastrana at 2 iba pa na local officials ng graft dahil sa pag hire ng private counsel, sa utos narin umano ng mga opisyal.

Sinampahan din ng administrative complaint ang kinuhang private counsel dahil sa isyu ng gross ignorance of the law.

Nakasaad sa Commission on Audit o COA Circular at Supreme Court decisions, ipinagbabawal sa mga government entities na mag-hire ng private counsel, hindi lamang para ipresenta sila sa korte, kundi maging sa lahat ng uri ng legal services, lalo na kung mula ang utos na ito sa mga tauhan ng gobyerno o empleyado na inaakusahan ng pag-abuso sa kapangyarihan.

Binanggit sa reklamo ng mga barangay chairman, ang Section 65 ng Local Government Code at ang SC decisions na nagsasabing mandatory ang pagsasagawa ng formal hearing at imbestigasyon bago suspendehin o tanggalin sa pwesto ang sinumang inihalal ng taumbayan or investigation before an elective officials can be suspended or remove from office.

Base sa impormasyon, sinuspende ang mga kapitan ng barangay dahil sa di nila pagdalo sa pulong ng liga ng mga Barangay sa Bayan ng Mauban.

Giit ng complainant na si Brgy. Chairman Rodante Almacen, mababaw na dahilan ang di nila pagdalo sa pulong para agad na suspendehin nang hindi man lamang dumadaan sa tamang proseso.
