LAGUNA—Pormal nang naghain ng Temporary Restraining Order at Motion for Reconsideration sa Court of Appeals ang Kapitan ng Barangay Caliraya sa Lumban, Laguna, matapos umano siyang sapilitang paalisin sa kanyang mga ari-arian at negosyo dahil sa pagpapatupad ng eviction order.
Giit ng kampo ni Silvino Dublan Jr., ilegal ang ginawang implementasyon ng sheriff dahil invalid at paso na umano ang ginamit na writ of execution.
Ayon sa kanyang abogado, mali ang pangalan ng establisimyento at address na nakasaad sa writ, at nawalan na ito ng bisa matapos na maibalik sa korte bilang unsatisfied.
Dagdag pa, wala na umanong hurisdiksyon ang Municipal Circuit Trial Court na ipatupad muli ang naturang writ habang nakabinbin ang kaso sa Court of Appeals.
Dahil dito, iginiit ng kampo ni Dublan na maaaring managot ang sheriff sa administratibo at kriminal na pananagutan, pati na sa posibleng danyos.
Samantala, sinabi ng kampo ni Dublan na may hawak siya ng Certification of Alienable and Disposable Land na inisyu ng DENR noong Hunyo 29, 2022, na ayon sa ahensya ay nagpapatunay lamang sa klasipikasyon ng lupa at hindi katumbas ng titulo.
Sa panig naman ng S.M. Fernando Realty and Development Corporation, nanindigan ang kumpanya na sila ang may hawak ng lehitimong titulo ng lupa, na ayon sa kanilang mga dokumento ay umiiral pa mula 1914 at nailipat sa kanila noong 1996.
Ayon pa sa kampo ni Dublan, hindi umano siya nakikialam sa lupang may titulo ang kumpanya dahil nasa ibang lokasyon aniya ang kanyang ari-arian, at iginiit na mali at ilegal ang naging pagpapatupad ng eviction order sa kanyang sinasakupan.
Patuloy namang inaantabayanan ang magiging desisyon ng Court of Appeals kaugnay ng mga mosyong inihain sa kontrobersyal na eviction sa Barangay Caliraya, Lumban, Laguna.
