By a vote of 126 ayes against 109 nays, the House of Representatives approved the divorce bill on Third and Final Reading in MANILA, May 22, 2024.

In a landmark decision, the HOR has passed the long-debated divorce bill, paving the way for the legalization of divorce in the Philippines. The bill received 126 votes in favor and 109 against during its Third and Final Reading.

This historic vote marks a significant shift in the nation’s stance on marital dissolution, as the Philippines is one of the last countries in the world, alongside Vatican City, without a divorce law. Advocates for the bill argue that it provides a legal avenue for individuals trapped in irreparable and often abusive marriages to seek relief and start anew.

Lawmakers agree that this represents a significant victory for countless Filipinos who have suffered in silence. They see it as a crucial step towards a more compassionate and just society.

However, the bill faces strong opposition from various religious groups and conservative lawmakers, who argue that it undermines the sanctity of marriage and family values. Representatives who voted against the bill, voiced their concerns, that it’s better to find ways to strengthen, not weaken, the family unit. Divorce is not the solution.”

The absolute divorce bill approved by the House “does not recognize no-fault, quickie, drive-thru, email or notarial” divorces, said Rep. Edcel Lagman (Albay, 1st District), the principal author of the draft bill that formed the basis of HB 9349. This provision aims to ensure that the process is thorough and just, addressing concerns about the potential for abuse or trivialization of divorce proceedings.

The bill now moves to the Senate, where it is expected to face rigorous debate. The Senate’s response will be crucial in determining the future of divorce legislation in the country.
