Naglabas ang Pasig City RTC Branch 71 ng Temporary Restraining Order (TRO) upang itigil ang ABC (Liga ng Barangay) special elections noong May 31, 2024 sa San Pedro City, Laguna.
Itong kautusan na bisa ng 20 araw na TRO na pirmado ni Judge Elisa R. Sarmiento-Flores at may petsa May 31, 2024.
Matatandaang naging magulo ang special elections ng Liga ng Barangay sa San Pedro City noong Enero 15, 2024 dahil nagsagawa din ng sariling halalan ang grupo ni Diwa Tee-Tayao.
Si Kap. Jun Ynion ang hinalal ng 14 na kapitan bilang Liga president samantalang sa kabilang panig, pinili ng Tayao-Art Mercado group si Kapitan Jimmy Madeigalejos.
Dumulog si San Pedro City Brgy San Antonio Chairman Eugenio Ynion Jr. sa Hukuman sa pamagitan ng Petition for Mandamus ay utusan ang National Executive Board (NEB) na kilalanin siya bilang nanalong ABC President ng Liga ng Barangay ng siyudad ng San Pedro.
Ayon kay Judge Sarmiento-Flores, binigyan ng Hukuman ang NEB ng sampung araw upang sagutin ang petition for mandamus ni ni San Antonio Kapitan Ynion.
Subalit nabigo ang NEB na magsumite ng kaukulang COMMENT sa kaso na inihain ni Kapitan Ynion.
Dahil dito, naglabas ang Hukuman noong May 20, 2024 ng Order para mag file ng MEMORADUM ang magkabilang panig upang mapag-aralan ang mga isyu sa kaso at makapag decision ito.
Lumalabas sa case records na natanggap ng NEB ang Order noong May 21, 2024.
Sa halip na sumunod ang NEB na magsumite ng memorandum, naglabas ito ng sariling decision sa nangyaring Liga ng Barangay Elections noong nakaraang January 15, 2024.
Nagpasya ang NEB na may FAILURE OF ELECTIONS sa magkabilang grupo at inatasan ang Liga San Pedro Chapter na gumanap ng panibagong special elections noong, May 31, 2024.
na sinasabing mali daw ang desisyon ng NEB.
Sinabi nito sa order na may petsa May 23, 2024 na pareho na hindi nagkaroon ng quorum ang dalawang grupo.
Ang katwiran ng NEB ay suspendido na noong January 15, 2024 si Kap Restituto P. Hernandez Jr. ng Chrysanthemum. Kaya hindi di umano valid ang kanyang pagdalo sa special elections.
Sa kabilang dako, nag pasya rin ang NEB na walang otoridad si Lord Jim Bullecer bilang kinatawan ng Chrysanthemum.
Walang ipinakita Sangguniang Barangay resolution si Bullecer na siya ang authorized representative ng barangay.
Kaya ang ginawa ng NEB, parehong itinuring na FAILURE OF ELECTIONS,
kapansin-pansin din daw para sa hukuman na hindi tinalakay ng NEB ang kaso ng San Pedro chapter ng Liga sa loob ng limang buwan.
Pinuna ng Korte na minabilis umano ng NEB ang decision noong natanggap ang Order na magsumite ng memorandum.
Hinabol daw kasi ng NEB, na halatang pumapanig di umano kay Tayao, na gumanap ng panibagong special elections habang suspended pa si Kap Resty ayon sa kampo ni Kap. Ynion.
Ito ang basehan ng Korte na pinagbigyan ang hiling ni Kap Ynion na itigil ang eleksyon noong nakaraang May 31, 2024.
