Bigo ang kampo ni San Pedro Mayor Art Mercado na ma-arraign si Brgy. San Antonio, San Pedro City, Laguna, Kapitan Eugenio”Jun” Ynion at maipahiya sa publiko sa pamagitan ng pagbasa ng sakdal sa kanya noong June 5, 2024.
Sa nangyaring hearing sa sala ni Judge Marlon DLM Amore ng San Pedro Municipal Trial Court in the Cities (MTCC) Branch 2, inatasan ng Korte si Atty. Joseph Benedict “Job” Gesmundo na mag komento sa loob ng sampung araw sa Motion to Quash na ihinain ng abogado ni Brgy.Chairman Jun Ynion.
Ayon sa nakadalo sa hearing, sinang-ayonan ng Korte ang hiling ni Kapitan Ynion na ipaliban muna ang arraignment habang hinihintay ang ruling sa Motion to Quash.
Itinakda ni Judge Amore ang sunod na hearing sa kaso sa July 31, 2024, isang hakbang na sinuway di umano ni Atty. Gesmundo.
Masyadong matagal pa raw ang July 31, 2024 para sa sunod na pagdinig sa kaso, sabi ni Atty. Gesmundo ayon sa mga nakasaksi.
Hindi raw nagustuhan ni Atty. Gesmundo ang ruling ng Hukom,may mga pasaring daw siya paglabas ng courtroom na may kalalagyan di umano si Judge dahil magsusumbong raw sa kanyang Tito na si Chief Justice Alexander Gesmundo.
Subalit hindi natinag ang Hukuman dahil may nakikitang merito sa Motion to Quash ni Chairman Ynion.
Ang Motion to Quash ay pamaraan na nakalaan sa Rules of Court na nagbibigay ng karapatan sa akusado na ipa-basura ang sakdal dahil hindi naipakita ang “probable cause.”
Kapag pinagbigyan ng Korte ang Motion to Quash, maaring i-dismiss kaagad-agad ang natitirang mga kaso laban kay Kapitan Ynion.
Kung matandaan, binasura ni Judge Amore ang anim sa labing isa na kaso na isinampa ng City Prosecutor’s Office noong araw mismo na inakyat ang mga sakdal sa Korte.
Ang dahilan ng dismissal ay ang pagkatuklas ng Korte na walang probable cause ang mga kasong isinampa kay Brgy Chairman Ynion.
