Recent incidents involving the repatriation of undocumented Filipino workers from Malaysia and the arrest of several foreign nationals in Siargao have once again brought attention to long-standing concerns over the Philippines’ outdated border security system.

Even before these cases, lawmakers had repeatedly warned that the country’s aging immigration infrastructure was no longer capable of effectively addressing modern threats such as human trafficking, terrorism, illegal migration, and transnational crime.

On June 16, authorities repatriated 11 Filipinos from Kota Kinabalu, Malaysia, after they left the country through illegal “backdoor” routes in search of overseas employment. Six of them bypassed legal departure procedures and worked in construction, mechanical, and maritime industries. According to the Bureau of Immigration (BI), most of the workers did not receive any salary during their employment.

Immigration Commissioner  said the incident demonstrates the dangers faced by Filipinos who leave the country through unauthorized routes to seek jobs abroad. He warned that illegal recruiters continue to exploit job seekers by promising overseas employment while encouraging them to evade legal departure requirements.

Just ten days later, on June 26, BI agents arrested 10 foreign nationals in  for violating immigration laws. Those arrested included four Israelis, two Chinese nationals, one Lithuanian, one Australian, one Moroccan, and one Nigerian. Authorities said the individuals were found overstaying their visas and engaging in gainful employment without the necessary permits.

Calls for Immigration Modernization

The two incidents have renewed calls to modernize the country’s immigration system, which still operates under the Philippine Immigration Act of 1940—an 85-year-old law that lawmakers believe is no longer adequate for present-day security challenges., who authored Senate Bill No. 1867 seeking to strengthen and modernize the BI, emphasized that a legal framework created before World War II can no longer address today’s evolving security threats.

Meanwhile,  has pushed for the passage of the BI Modernization Bill, saying it would both improve travel convenience and strengthen national border security.

“This bill’s importance cannot be overstated… It is two-pronged in that it will improve travel experience and at the same time tighten up our border security.”

also stressed the need to improve data integrity and tighten maritime border controls. He pointed out that while airports are heavily monitored, seaports and maritime routes remain vulnerable to illegal entry and smuggling activities.

Tulfo previously warned that foreign nationals could be entering the Philippines illegally through dredging vessels, exposing another potential weakness in the country’s border security.

Proposed High-Tech Border Security System

To address these concerns, the BI is reviewing the proposed Civil Aviation and Immigration Security Services (CAISS) project, a P10.74-billion public-private partnership that aims to modernize immigration operations across all 11 international airports in the country.

BI spokesperson  described the proposal as a fully integrated, end-to-end border security solution that would cover frontline operations, data collection, processing, and assessment.

The project includes biometric verification, electronic gates, contactless facial recognition, AI-powered passenger screening, automated border control systems, advanced passenger information systems, biometric kiosks, and deception detection technology designed to identify human traffickers, terrorists, and other high-risk travelers before they enter or leave the country.

The proposal has already completed the Swiss challenge process without any competing bidders. It will operate under a user-pay model, where travelers may pay a $4 (around P240) fee for every international arrival or departure. The system also includes a mandatory technology upgrade every four years to ensure the BI continues using modern security equipment without additional cost to taxpayers.

The collection of user fees is authorized under Section 13 of Republic Act No. 11966, or the Public-Private Partnership Code of the Philippines, which allows the approval and regulation of fees for PPP projects.

Commissioner Viado reiterated that modernizing the country’s border management infrastructure is essential to strengthen efforts against human trafficking, terrorism, illegal immigration, and other emerging security threats.

With cases of unauthorized departures, illegal entry, and transnational crime continuing to pose serious risks, both lawmakers and immigration officials agree that the Philippines can no longer rely on an 85-year-old immigration framework to protect its borders.
