Cayetano umapela na pag-aralan ng Malacañang ang house arrest ni Duterte

Pag-aralan sana ng Malacañang ang mungkahing hilingin sa International Criminal Court (ICC) na ilagay sa house arrest ang dating Pangulong Rodrigo Duterte sa humanitarian grounds.

Ito ang apela ni Senate Minority Leader Alan Peter Cayetano matapos talakayin ng Senado ang Senate Resolution No. 144 nitong October 1, 2025. Inilatag ni Cayetano ang resolusyon bilang isa sa mga orihinal na may-akda ng halos kaparehas na panukala na inihain niya noong Hulyo.

“Ang appeal lang po is humanitarian treatment and that we do it as a country. First step ang sa Senate. But I’ll use this podium to appeal to Malacañang na pag-aralan naman nila ito just on humanitarian grounds. Huwag na po nila pansinin ang lahat ng tumitira. Ang punto dito — he is a citizen of the country, he is 80 years old, he needs medical attention, he needs his family, and he needs people to talk to,” wika ng Minority Leader.

“Kapag tinakpan natin ang pangalan o mukha niya at ganoon ang sitwasyon, tutulong ba tayo o hindi?” aniya, sabay giit sa pangangailangan ng pantay na access sa tulong legal para sa lahat ng Pilipino, sinuman sila.

Kabilang sa mga sponsor ng panukala sina Senate Majority Leader Juan Miguel Zubiri, at mga senador mula sa Minority bloc na sina Christopher “Bong” Go, Robinhood Padilla, Ronald “Bato” dela Rosa, Imee Marcos, Rodante Marcoleta, Joel Villanueva, at Jinggoy Estrada. Tumayo sila upang isulong ang panukala at himukin ang ICC na isaalang-alang ang edad at humihinang kalusugan ni Duterte sa pagpapasya sa kondisyon ng kanyang pagkakakulong.

Halos pitong buwan nang nakakulong sa The Hague, Netherlands ang dating Pangulo na iniulat na dumaranas ng malubhang sakit at hindi maayos na pag-iisip, dahilan upang ipagpaliban ng ICC ang kanyang confirmation of charges hearing.

Dahil dito, hinihiling ng Senate Resolution No. 144 na magtalaga ang ICC ng isang doktor upang suriin kung nasa tamang kalusugan at pag-iisip si Duterte upang humarap sa trial.

Kung ipinakikita ng pagsusuri na maaaring palalain ng regular na pagkakakulong ang kanyang kalusugan, hinihiling ng resolusyon na isaalang-alang ng ICC ang house arrest.

Naghahanap din ito ng mga alternatibong arrangement para sa pagkakakulong ng dating Pangulo, tulad ng house arrest. Ngunit giit ng resolusyon, mahigpit itong ipapatupad upang malimita ang kanyang kalayaan at para hindi makompromiso ang integridad ng paglilitis.

Kabilang dito ang “staying at a particular address, not contacting directly or indirectly victims or witnesses, and responding when summoned by an authority or qualified person designated by the ICC.”

Binanggit din ng resolusyon ang Article 10 (1) ng International Covenant on Civil and Political Rights, na nagsasaad na, “All persons deprived of their liberty shall be treated with humanity and with respect for the inherent dignity of the human person.”

Sinabi ni Cayetano na hindi babalewalain ng resolusyon ang mga kasong crimes against humanity na kinahaharap ni Duterte sa ICC.

“There’s a lot of things that we have to account for. There’s a lot of truth that has to be uncovered… Human rights are important. All these issues will be threshed out in the ICC. One thing we don’t want to do is to see the former President suffer as if it is a punishment when he has not been convicted. Not only for him, but for us as a nation,” paliwanag niya.

“I cannot imagine what the country will do if something happens to him in the detention center at wala man tayong ginawa,” dagdag pa niya.

Labinlimang senador ang bumoto para sa kolektibong panukala, samantalang 3 ang tumutol at 2 ang bumoto ng abswelto dito.

Pinagtibay nito ang mga katulad na resolusyon na naunang inihain sa 20th Congress ng Minority senators na nananawagan sa gobyerno na pormal na hingin sa ICC na bigyan si Duterte ng interim release sa pamamagitan ng house arrest para sa humanitarian grounds, kabilang ang Senate Resolution No.17 na inihain ni Cayetano nitong Hulyo.
